Terms of Service

1. AGREEMENT TO TERMS By accessing this gallery website, entering your email address to view photos, or downloading content, you agree to these Terms of Service. These terms apply to all visitors, including the contracting Client and their invited Guests.

2. GALLERY ACCESS & PRIVACY

Email Collection: To access certain galleries, you may be required to enter your email address. This is for security, identification, and functionality purposes (e.g., saving "Favorites"). By entering your email, you consent to the Photographer contacting you regarding this specific event or gallery.
Password/PIN Protection: If you are provided with a Password or Download PIN, you are responsible for keeping it confidential. The Photographer is not liable for any privacy breaches resulting from the Client sharing their access codes with third parties.
Private/Exclusive Content: You agree not to attempt to bypass security measures to access hidden sets or photos not intended for public viewing.

3. GALLERY EXPIRATION & ARCHIVING IMPORTANT: Client galleries are not permanent storage solutions.

Online Duration: Galleries generally remain active for 6 to 12 months from the release date, depending on the specific service agreement. After this period, the gallery may be archived or permanently deleted to free up server space.
Download Responsibility: It is the sole responsibility of the Client and Guests to download and back up their images to their own devices (Hard Drives/Cloud Storage) before the gallery expires.
Restoration Fees: If a gallery has been archived, a fee may be charged to un-archive and re-upload the images, subject to availability. The Photographer does not guarantee that files will be retained indefinitely after the contract period ends.

4. INTELLECTUAL PROPERTY The images contained in this gallery are the intellectual property of Benedikt Sebastian.

No Screen Capture: While we understand you want to share photos, please use the official "Download" or "Share" buttons provided. Taking screenshots of watermarked images degrades quality and infringes on copyright.
Social Media Sharing: You are encouraged to share your downloaded images on social media with proper credit (@benediktshoots or @benediktsebastian). Please refer to the Digital Image License for full usage rules.

5. PLATFORM AVAILABILITY This gallery is hosted by a third-party provider (Pixieset). While we strive for 100% uptime, the Photographer is not responsible for temporary outages, server maintenance, or technical glitches caused by the Pixieset platform that may temporarily prevent access or downloads.

6. PRINT STORE & FULFILLMENT Prints and products purchased through this gallery are fulfilled by professional third-party labs (e.g., WHCC, Miller's).

Quality Variance: Please note that computer screens are backlit and calibrated differently. Physical prints may appear slightly darker or softer than what is seen on a high-brightness phone screen. This is standard in the printing industry and is not considered a defect.
Shipping: The Photographer acts as the facilitator for these orders. We are not liable for shipping delays caused by the carrier (FedEx/UPS).

7. LIMITATION OF LIABILITY In no event shall Benedikt Sebastian be liable for any indirect, incidental, or consequential damages arising from the use of this gallery, including but not limited to the loss of data (digital files) after the gallery expiration date.

8. GOVERNING LAW These terms are governed by the laws of the State of California.
